Attorney: Dave Herman was duped by cop

GavelHis lawyer claims the former iconic WNEW-FM NYC DJ was fooled by an undercover cop in a sex sting. Attorney Marc Agnifilo tells The Star-Ledger that 77-year-old Herman received a photo from a female officer who made it clear that “the only way he could meet her was to engage in banter about the child.”


Herman is accused of trying to transport a 7-year-old New Jersey girl to the U.S. Virgin Islands for sex. He was arrested last week at the St. Croix airport. Federal authorities say Herman had expected to meet the girl and her mother flying in from New York.

“The woman who posed as the 36-year-old woman, the detective (from the Bergen Prosecutor’s Office), sent a photograph of herself,” Agnifilo, told the Star-Ledger after meeting with Herman at a jail in St. Croix earlier this week. “She was, in his estimation, reasonably attractive, and I think he was looking forward to meeting her and the way that the detective created this scenario, the only way to meet … was to engage in this banter regarding the child.”

Herman, who has a home in St. Croix, is being held in jail pending his transfer to New Jersey to face the federal charge, “which carries a minimum sentence of 10 years in prison and a maximum of life. The complaint against Herman was filed in federal court in Newark; the official charge is attempting to transport a minor in interstate commerce with the intent that the minor engage in sexual activity,” said the story.

The attorney also said Herman is eager to return to New Jersey to fight the charges. He said Herman suffers from emphysema, and called the jail in St. Croix “spartan and hot.”
