FCCAnd the bidder is the loser. A participant in 2004’s FM Auction No. 37 withdrew and got stuck with a hefty bill as the CP in question went for a lower high bid. In seeking a lower payment, the bidder cited a precedent.


However, both the FCC and the courts say the precedent does not apply.
