Accusations of monopolization of a national radio advertising bundling market brought to a federal judge in Oregon by Talk Radio Network Enterprises LLC may live on.


However, should the entity and other producers who sued Cumulus Media seek to try again in their fight against the nation’s No. 2 radio operator, they will have to do so with half of the claims they originally filed.

According to Law360, U.S. District Judge Ann L. Aiken on Monday followed the recommendation of a magistrate judge to set aside an antitrust suit brought by TRN and a group of other radio producers.

Aiken tossed half the allegations with prejudice, Law360 reports, and half without. The decision was based on a September 2016 conclusion from U.S. Magistrate Judge Mark D. Clarke that a motion to dismiss be granted.
