RBR observation: WCBS has
all eyes back on radio
Just like we told 'ya first: CBS-FM NY is coming back this week, (7/6/07 RBR #131) ....and with the format we imagined ("We estimate the format will be a bit updated - maybe hits and deeper cuts from the 60's, 70s and 80's"). A little over two years since the station's format was changed to JACK FM/adult hits, CBS-FM's legendary sound will mark its return beginning on Thursday, July 12 at 1:01PM, ET (JACK FM will be now available on-air on CBS-FM's HD 2 channel as well as streamed online). This news has caused a tremendous rumble inside NYC-even more than when it was blown up for Jack FM. The anticipation factor gleaned phenomenal press. As CBS Radio CEO Dan Mason noted to RBR, the headlines were big, and could be found in The New York Times, The NY Daily News, The NY Post, Crain's NY Business, Forbes, etc.: "When is the last time you've seen 1-ft headlines on a NY paper?" Our opinion: Dan and CBS Radio now have the opportunity (sitting at the media hub of the entire world) with Wall Street and the agency/client community to show the revitalization and rebirth of good radio. Emmis steps up this morning
The first report of the quarterly cycle comes today as Emmis Communications reports on results for its fiscal Q1 (March-May). But with the company-specific problems Emmis has been battling, the company is no longer a bellwether for the radio industry, except that folks will be listening to hear what Jeff Smulyan says about the New York and LA markets. Analyst Marci Ryvicker at Wachovia expects domestic radio revenues to be down 10% and international to be off 5%. That would make for consolidated revenues of 85 million (including publishing as well), which Ryvicker notes is in line with her analyst peers on Wall Street. With Emmis spending on promotion for stations in LA and NYC, those expenses are reducing cash flow in hopes of building future growth. Thus, Ryvicker expects EBITDA to be down around 40% to 13 million, also in line with the consensus.


Wachovia: Ad environment weaker than expected
Marci Ryvicker, VP/Equity Research Wachovia Capital Markets, reports the ad environment is now weaker than was expected and they have lowered their forecasts: "The resilience of consumer confidence and spending may not be sustainable given 1) the persistent price increases of everyday necessities (i.e. gas, dairy); 2) the fear of interest rate hikes to curb inflation; and 3) the depressed real estate market. In fact, the real estate market is wreaking havoc in many areas of the country, specifically the West and Southeast, which could adversely affect ad dollars. As a result, we reduced our '07 advertising forecast by 200 basis points (bps), to 2.3% from 4.3%.

FCC goes over CCU with
fine-tooth comb

Size is not a factor when it comes to following the most basic FCC rules. With platoons of employees listing centuries worth of cumulative broadcast experience on their resumes, the biggest radio company in the history of the world has nonetheless been caught with its public files down. Well, not down so much as incomplete. And it wasn't all small, out of the way stations, either. Six stations were caught in the FCC's dragnet, all with various file omissions. Three were hit with 10K fines, including WHJY-FM Providence, WZKF-FM Louisville (Salem IN) and WKCI-FM New Haven (Hamden CT). Getting off a bit easier, at 4K a pop, were WKLB-FM Detroit, WJMN-FM Boston and KABQ-FM Albuquerque (Santa Fe NM). For those of you keeping score at home, that adds up to a total of 42K.

RBR observation: For all we know, 42K is what the Lowry Mays' outfit spends each month on non-dairy creamer. But we have no doubt that Clear Channel can think of many uses for the cash other than helping to defray the national debt. We again remind everybody to have at least two or more people at each station who know what goes into the file and are responsible for making sure it remains up to date. 42K may not be a major setback to CCU, but it sure might be to a little mom and pop station in a town with one traffic light, which is every bit as susceptible to this kind of assessment as Clear Channel is.


The urge to merge, handicapped
M & A Researcher is keeping its eye on progress of the proposed wedding of XM Satellite Radio and Sirius Satellite Radio. It notes that although there have been splashes made from both sides, the high-profile support for the merger from former FCC Commissioner Harold Furchtgott-Roth and accompanying letters of support from generally small public organizations may have given some the impression that the merger's prospects are incrementally improving. However, it notes that the NAB has been countering just about every pro-merger opinion in a neutralization campaign, and that in reality, neither side has recently added much of substance to the debate. It further suggests that it will be well into the autumn at the earliest before we have any idea what either the FCC or DOJ are thinking about the proposal. In the final analysis, putting on its oddsmaker cap, M & A suggests that the merger's chances of success are precisely where it put them earlier, at 33%.

Watchdog hits CBS, Fox
over chaste ad decision

Usually broadcasters find themselves defending the amount of sexual content on their programming against assaults from watchdog groups who find it all too racy and inappropriate. But not AIDS Healthcare Foundation (AHF). This group finds it to be the height of hypocrisy that given the amount of racy content, two networks refused to run advertising for condoms. At issue is a campaign from Trojan called "Evolve," which encourages condom use to in turn discourage the spread of STDs. AHF says the ad was accepted on ABC, NBC and at least nine cable networks, but CBS and Fox refused it. Michael Weinstein (pictured), President of AIDS Healthcare Foundation, said, "On any given day or night, Viagra and other similar ads also run regularly on these networks - there seems to be no squeamishness about Fox and CBS airing shows or selling commercial time to promote sex. However, these networks now draw the line when Trojan tries to promote its condoms as a means toward safer sex-including the prevention of STDs and unwanted pregnancies. We strongly urge the advertising 'suits' at both of these networks to do what this ad encourages - 'evolve' - and reconsider their misguided ban on this commercial."

RBR observation: Turning down a paid ad is of course not the best thing for business, so you can't fault the motives of CBS and Fox in trying to exercise their best judgment on what is appropriate for their airspace. However, we still believe it is almost always best to be erring in favor of airing. The fact that the ads are running elsewhere, and that other types of programming and commercial material can be compared to the rejected Trojan material simply makes the roadblocking networks look silly.

BIA fund raises 195 million
BIA Digital Partners says its second private equity fund exceeded its 150 million bucks target and BIA Digital Partners II LP is now a 195 million bucks mezzanine fund. The fund closed on 65 million of capital commitments from limited partners, which BIA says with leverage translates to a fund size of 195 million. The fund is licensed by the SBA as a Small business Investment Company. The fund provides mezzanine capital for small to medium sized media, telecom, information and related business services firms in the US, with five investments concluded thus far.

Soothsayer Rich Russo on the WCBS-FM switchback
Chalk up WCBS-FM NY (see related story) as yet another successful radio prediction up for Rich Russo, JL Media's SVP/Director of Broadcast Services. Here are his comments from March on the hiring of Dan Mason to run CBS Radio (3/28/07 RBR #61): "This will be a cakewalk for him, he's a programming guy, a big chunk of their difficulties have been programming issues and personnel, in one wave of his hand, he'll probably turn one of the NY FMs to Rock, one of the other NY FMs to Oldies and in 30 seconds he can reverse the fortunes and perception of his company. He'll clear up some of the other markets and do similar things as needed. As we have said all along, it's always about programming and content, so at least now there is someone who is an expert in that. Hopefully he will bring in a top level sales manager to get it all on track. This will be a no-brainer for Dan Mason, it will be as easy as hitting a pinata without a blindfold." Indeed, that is just what's been happening. Russo also had a few criticisms on the Jack format that seem to now be materializing. He labeled it "Jack Sh*t" and we ran it before there were any ratings info on the stations.

He commented to RBR yesterday about the big WCBS switch: "The irony of all this is that the original CBS-FM was the original JACK format or at least so in theory, think about it, CBS-FM would play any genre of music as long as it was a hit at some point, they would play Dion, Donna Summer, Eddie Rabbit and Frank Sinatra in the same pod. There was no overanalyzation of the songs, if it charted, it got played. The problem with the Jack formats that have failed are due to overprogramming and overthought, it had no spontaneity, no WOW factor, just a thinly veiled classic hits station with no heritage and no sense of the spirit of it. The ones that have worked and the hybrids have captured that spirit within its markets. New York never was able to get out of the shadow of CBS-FM because the listeners knew they had the original and trusted the DJ's etc, JACK threw that trust out the window. There is no reason that the re-emergence of CBS-FM now can't be a top 10 station in NYC and add at least 50% more revenue to what JACK was doing. Barring any programming missteps, this will be a home run." ...and that's coming from the buying community-CBS-FM shouldn't be a tough sell in the Big Apple...!

Yellow Book launches campaign
featuring David Carradine

Yellow Book USA has launched a new national television campaign, via Trahan Burden & Charles (TBC) that positions its print and online products as an easily-accessible and comprehensive way for business advertisers to grow their customer base. Launching nationally yesterday, the spots depict television and film star David Carradine playing the part of the mystical ad "Guru" who reveals to questioning business owners that an effective way to increase their customer base is through Yellow Book's ad products. The campaign demonstrates how businesses can reach customers using a variety of Yellow Book channels, including traditional print directories, Internet yellow pages, and search engine advertising through Yellow Book's WebReach program. The new ads also introduce Yellow Book's new tag: "Wherever you look. Yellow Book."

Diet Coke celebrates 25 years
25 years ago, Diet Coke burst onto the scene. Today, the global brand is the #1 diet sparkling beverage in the world, and its launch is viewed as one of the most successful in beverage history. Diet Coke has been a sponsor of the Academy Awards and the brand's current marketing campaign premiered with three new commercials during this year's Oscars telecast. The campaign, which carries the tag, "Yours, Diet Coke," shows how people feel about Diet Coke when they drink it, and as importantly, how they feel when it's not there. The ads depict scenarios that reinforce how Diet Coke is there for people who love the brand. To celebrate 25 years, limited edition vintage Diet Coke T-shirts, 25th anniversary contour bottles and other commemorative items will be available through My Coke Rewards. Multicultural station to get religion?
Arthur Liu's Multicultural Radio is liquidating one of its big market AM stations according to broker Bill Schutz, sending WNTD-AM Chicago to Catholic specialist Mark Follett. The deal will cover about 10% of Liu's acquisition of it and 14 other stations from Radio Unica back in 2003. Follett is getting the station under licensee name Sovereign City Communications. Schutz says he also runs stations under the name Relevant Radio, which owns 17 stations and has affiliation agreements in place with 17 more. Documents filed with the FCC place the value of WNTD at 15M cash.

Close encounter upstate
A trio of FMs have spun out of the Galzxy orbit and are now officially in the ever-expanding portfolio of Educational Media Foundation. Broker John Pierce tells us that the 3.5M deal sending WBOE-FM an WOOB-FM in the Albany-Schenectady Troy market, along with WSCP-FM Syracuse to EMF is not closed. Pierce represented EMF, across the table from Bill Schutz who represented seller Galaxy. Pierce says EMF has been running the stations since February in an LMA.

Slow time in Washington gets even slower
The summer doldrums are setting in inside the Beltway. Congress is back from its observance of the Fourth of July, but is getting set for its August recess. The communications bureaucratic watchdog communities are slow-walking as a proportion of their staffing rotates out of town on vacation. But there was a prime event on the calendar for this week: The House Subcommittee on Commerce, Trade and Consumer Protection was all set for a session called "From Imus to Industry: The Business of Stereotypes and Degrading Images." This title seems to hold out promise for some interesting verbal fireworks, if nothing else. But it is not to be, not this week, anyway. The hearing, scheduled for Wednesday, 7/11/07, has been postponed. A new date has not been announced.

Dan Patrick to leave ESPN
Dan Patrick will be leaving ESPN, with his final radio broadcast to be on Friday, Aug. 17. The mutual agreement will allow Patrick to pursue new interests outside of ESPN, and will bring to an end his involvement with ESPN's radio, television and magazine outlets. The week of Patrick's final show, ESPN Radio will look back at memorable moments from the show, in addition to featuring special guest appearances and interviews. Rumor has it he may join Sporting News Radio, as Patrick's brother is head of programming at there. Patrick said: "I've spent a third of my life at ESPN. All my children were born while I was employed here. I feel privileged to have had this opportunity and I have extremely mixed emotions about leaving. With that said, I told ESPN that I believe it's time for me to try something different, something that will also be challenging and rewarding. While I'm not sure what that will be, I am grateful to ESPN for its willingness to allow me to pursue new endeavors." Williamson added, "Dan has accomplished so much over the past two decades at ESPN and fans and newsmakers have turned to him for his steady and trusted approach. We wish him the very best." Patrick has hosted ESPN Radio's Dan Patrick Show since 1999.

Imus to return in January?
That's what the Drudge Report is speculating. News of the comeback first broke in the NY Post (7/3/07 RBR #129). Said the report: "Controversial radio host Don Imus is considering a return to the airwaves -- as early as this coming January, the Drudge Report has learned. Legal issues pending with CBS must first be resolved before any dramatic return to the airwaves. 'We're going to see Don back in front of a microphone for the '08 election," said a top source close to Imus. The source would not reveal where Imus would make his comeback."

"By offering our content on mSpot, we are rapidly expanding both the range and reach of our customer base," said John Rosso, ABC Radio Networks senior vice president, affiliate relations and digital media. "We are committed to being at the forefront of new ways to deliver content to our listeners and affiliates. Our partnership with mSpot reflects our constant drive to meet listener demands." mSpot Radio has more than 100 channels of news, sports, finance, entertainment, talk, podcasts, and videos from radio's most recognized brands -- NPR, FOX Sports, Radio Disney, Clear Channel, Marketwatch, and CBS Radio. Traffic data goes
HD with CC Radio

Clear Channel Radio's Total Traffic Network has begun transmitting traffic data via HD Radio in 48 of the largest metros. This launch marks the first commercially available data service over HD Radio. CC Radio is working with a variety of receiver manufacturers to make the specially-equipped receivers available by the end of the year. Total Traffic Network also announced that it has further expanded its delivery of real-time traffic data over RDS-TMC (Radio Data System Traffic Message Channel) with the addition of 19 new markets that include: Albany, NY; Albuquerque, NM; Birmingham, AL; Columbia, SC; Fort Myers, FL; Louisville, KY; Omaha, NE; Portsmouth/Manchester, NH; Richmond, VA; Rochester, NY; Sarasota, FL; Springfield, MA; Syracuse, NY; Toledo, OH; Tucson, AZ; Worcester, MA and Toronto, ON; Ottawa, ON and Montreal, QE in Canada. Total Traffic Network now delivers real time traffic via RDS-TMC in 68 cities, and plans to add more markets to its data delivery via RDS-TMC throughout 2007. This expanded coverage is made available to existing subscribers without additional charge. Total Traffic currently provides real-time traffic information to devices made by Garmin, TomTom, Mio-Mitac, Delphi, Kenwood, Clarion, Navigon, Cobra Electronics and Siemens VDO and supplies traffic content to several media outlets including Citadel, Univision, Fox Interactive Media, and others. In September 2006, CC Radio announced a milestone agreement with BMW in which they became the first automotive brand in the US to offer real-time traffic as a subscription free service included with navigation on select models. Earlier this year, BMW's MINI USA became the second automotive brand to announce such a relationship.

HD award to be given in Charlotte
NAB announced establishment of a new award to recognize HD Radio programming. The NAB HD Radio Multicast Award will be given to a multicast station that is creating "unique, innovative or groundbreaking programming." The first award will be presented at the keynote session on Thursday, September 27th during The NAB Radio Show in Charlotte. "In addition to offering a crystal-clear listening experience, HD Radio provides listeners with an even richer array of formats while expanding a local station's programming opportunities. This award will recognize stations that make significant strides in utilizing HD Radio to enhance their local audience's listening experience," said NAB Executive Vice President John David. Stock Talk
Stocks up, but traders cautious
With the quarterly round of earnings reports set to begin, traders were cautious in Monday's trading, although they welcomed a drop in T-bill yields. The Dow Industrials rose 38 points, or 0.3%, to 13,650.

Radio stocks were slightly higher. The Radio Index rose 0.102, or 0.1%, to 158.780. Citadel was the biggest mover, up 2.7% after announcing a deal with mSpot radio. Entravision gained 2.1%.

Change at the top
Lincoln Financial Group announced plans for Jon A. Boscia to retire September 1st and immediately turn over his executive posts to successors. Long time director J. Patrick Barrett, former CEO of Avis, has been elected Chairman of the Board. Succeeding Boscia as CEO is Dennis R. Glass, pictured, who had been President and COO. Glass is a familiar name to RBR readers, since he had been CEO of Jefferson-Pilot Corp. prior to its merger with Lincoln last year. Lincoln recently announced that it was considering a sell-off of its broadcasting subsidiary, Lincoln Financial Media, formerly Jefferson-Pilot Communications (6/8/07 RBR #112).

Staying put
Entercom's WAAF-FM Boston announced that it has signed Mike Hsu to a new multi-year contract. Hsu is currently the host of his own show in WAAF's 10:00 am to 3:00 pm slot, Monday through Friday. Hsu has been with WAAF since 1998 and is well known for his daily "Lost and Found" and "Coffee Break Request" segments.

Gunzerath to MRC
David Gunzerath has joined the Media Rating Council (MRC) as Senior Vice President and Associate Director, charged with focusing on assuring that audits are effective and thoroughly acted upon by the measurement services working with the MRC. He will also work to strengthen new auditing areas, such as Internet and interactive measurement. For the past eight years, Gunzerath was VP of Research and Information for NAB.

Hall of Famer
Greater Media Detroit Senior Vice President & Regional General Manager Tom Bender will be officially inducted into the Michigan Association of Broadcasters (MAB) Hall of Fame. The presentation will take place during the MAB's annual conference today in Grand Rapids. Bender, who is responsible for overseeing Greater Media's Detroit-based radio properties, including WRIF-FM, WCSX-FM and WMGC-FM, has been with the company since 1986.

Smashing Pumpkins take over K-Rock in NYC
On Thursday, K-Rock NYC becomes Cherub Rock as the Smashing Pumpkins take over afternoon drive there. Fresh off their Live Earth performance and The Late Show with David Letterman appearance, the Smashing Pumpkins will be commandeering the airwaves playing their favorite K-Rock music and tracks from their new CD, "Zeitgeist". It's their first batch of new material since 2000. The first single, Tarantula, is one of the most requested songs on K-Rock right now. The station says stay tuned for more Hostile Takeovers all summer long.

Howie Carr:
Jumping or not?

The Boston Herald reported on its website yesterday that WRKO-AM Boston afternoon talk host Howie Carr has signed a deal to do mornings on Greater Media's WTKK-FM, the spot formerly occupied by Don Imus, once his WRKO contract expires in September. The story quoted lawyer Bret Cohen, since Carr himself is on vacation. But WRKO spokesman George Regan sent RBR this statement last evening: "Howie Carr is under contract to Entercom. He is a tremendous asset to WRKO and Entercom has every intention of retaining his services for many years to come. Any report suggesting a change is incredibly premature." Which station will have Carr? Stay tuned.

Like everyone else in the radio and/or records trade press we saw the BusinessWeek story last week about the report by University of Texas at Dallas economics professor Stan J. Liebowitz which concluded that the conventional wisdom of radio air play increasing record sales is dead wrong - that, rather, air play decreases record sales. Unlike the rest of the trade press, we decided to read the research paper and here is the RBR finding in this report page.

Arbitron looks at
Jack, Bob, Oldies trends
As word continues to spread about WCBS-FM NY switching back to Oldies this week (you read it here First at RBR (07/06/07 RBR #131) and widely picked up by the consumer press, Arbitron took a look Friday at two formats of note in the Arbitron Radio Listening Trends, based on the continuously measured markets.

WCBS-FM coming back
to The Big Apple!
As we mentioned first in yesterday's Media Business Report (7/5/07 MBR): Word on the street is that WCBS-FM NY is heading back to Oldies next week and dropping "Jack FM." CBS Radio had no official comment. Needless to say, the move to switch the station from its original Oldies format to "Jack FM" was met with a lot of criticism.
