As part of the current license renewal process, the FCC Media Bureau has hit a whopping 28 broadcast stations with $3K fines for problems with their public files. All were radio stations. Although the statutory max on the fines was $4K, the MB ratcheted them down one grand in view of the licensees' "voluntary disclosures of the violations."

A media giant is born: NBC Universal
A little over a month after General Electric/NBC won the bidding for the US entertainment assets of Vivendi Universal, the $14B acquisition has been finalized. The merger, which is expected to close next year, will create a $43B media giant called NBC Universal, which will rival Viacom, Disney and News Corp. in scope and size.

The proposed merger of NBC and Vivendi Universal Entertainment (VUE) had gotten little attention on Capitol Hill, since VUE has no broadcast licenses. Tempe tantrum? Station hit for phone violation
The situation in Phoenix reminds us a little of the Al Capone situation way back when. Unable to stick any charges on Capone's illegal doings, the feds eventually nailed him on tax charges. A since-fired DJ at Sandusky's KUPD-FM (licensed to Tempe AZ) infamously made a prank call to the widow of St. Louis pitcher Darryl Kile. Unable to prosecute the station on grounds of pure tastelessness, the FCC was able to slap its wrists with a $4K phone violation fine. McDonalds' launching
"Real Life Choices" in January

The NY Daily News reports McDonald's is beefing up its nutrition education program in New York, via an initiative this January dubbed "Real Life Choices." The program will not include any new menu items. Instead, it will offer helpful suggestions on how to make existing sandwiches and treats more healthy. It may, for instance, tell dieters seeking fewer carbohydrates to skip the bun, or suggest barbecue sauce instead of mayonnaise-based toppings, the story said. | Full Story Click Here |

Dentsu named Hawaii's new marketing
contractor to Japan
The Honolulu Star-Bulletin reports the Hawaii Visitors & Convention Bureau has tapped Dentsu, the major Japanese agency, to handle its $1M account marketing the state to Japanese tourists. The review was initiated because Hawaii had been losing Japanese travel share since 1992, when 14.5% of Japanese outbound travelers came to the islands, according to the Hawaii Department of Business, Economic Development and Tourism and the Pacific Asia Travel Association. Brownfield buys AgriAmerica/Indiana
Learfield Communications, parent of agricultural news provider Brownfield Network agreed to purchase AgriAmerica Network's Indiana operations from Emmis' WIBC-AM Indianapolis. Learfield will merge AgriAmerica's Indiana operations into Brownfield. Closing is expected 11/30. AgriAmerica co-founder Gary Truitt stays on board.

Do-Not-Call goes into effect
The 10th Circuit Court has decided to let the national Do-Not-Call Registry go into operation pending judicial review. The judges said that the privacy of individual Americans outweighs economic harm to telemarketers. Wall Street winning streak ends
Optimism gave way to pessimism as Wall Street traders tried to figure out where they should be for the coming round of quarterly reports. In reality, though, there was no news to account for Wednesday's negative shift. The best explanation was that traders got nervous as many stock prices approached their 52-week highs. The Dow Industrials ended the day down 24 points, or 0.3%, at 9,631.

Most radio stocks had a down day, but there were gainers as well. Radio Unica moved up 12 cents to 70 cents as speculators placed bets on how much the payout will be once the company is dissolved. Lightly traded Regent dropped 5.6% to $6.64. The biggest radio company of all, Clear Channel, declined 2.4% to $40.53.

The Radio Index fell 2.756, or 1.1%, to 251.088.

to stick with contours
After studying alternatives to using contour overlaps to define radio market outside the Arbitron markets, the NAB is telling the FCC it should leave well enough alone.

Michael Copps was less than impressed with the fines imposed on Clear Channel and Viacom/Infinity for indecent broadcasts Commissioner Kathleen Abernathy also made noises about making the consistently indecent begin to pay for their transgressions. An important point, Arbitron is in a tough spot right now with PPM, because the business of radio is based on the diary: "A lot of money is spent on the basis of the results of the diary.
