Both the FCC and Congress think that the time is ripe to open up third-adjacent FM channels to the new low power FM service. The FCC is looking in general into ways to facilitate new stations, and is now accepting comment on the topic. The item is MM Docket No. 99-25 Low Power FM Notice of Proposed Rulemaking. It is in fact a Third Report & Order and Second Further Notice of Proposed Rulemaking. It hit the Federal Register 3/6/08, and comments are due 4/7/08 with the deadline for reply comments set at 4/21/08. The FCC advises commenters to "follow the filing instructions provided in paragraphs 86 to 88 of the Second Further Notice," which is available on its website.
Iger sees opportunities for Disney
But while Disney is building its presence in new media, Iger said “TV is still a very powerful medium – we denigrate it by calling it old,” so there are multiple opportunities for future growth. “You introduce something on something we’ll call a mature platform, but you extend it through new media,” he explained.
The Disney boss is not worried about the just-completed acquisition of DoubleClick by Google. Iger said Google, Microsoft and Yahoo! all need content from companies like Disney, so they actually create value for his company. And, by the way, he said Disney has no interest in buying AOL.
Week 24: Broadcast 95, cable 5
Broadcast networks had 95 of the top 100 show in the 18-49 demo for the most recent week. The weekly number crunch of Nielsen data by the Television Bureau of Advertising (TVB) found that of the five cable/satellite shows in the top 100, the highest ranked was "WWE Entertainment" on USA at #55. The other four were way back at 95 through 99.

One celery stalk, a gallon of milk and a converter box
Not every town in the US can support a consumer electronics store, but you can bet that almost all of them have a grocery store of two. To make sure all consumers have easy access to digital-to-analog converter boxes, NAB is asking NTIA to put grocery stores on its list of approved converter box retail outlets. In a letter to NTIA head Meredith Attwell Baker, NAB’s David K. Rehr wrote, "I believe that an accommodation should be made for grocery stores, and that at a minimum information on NTIA’s program and its waiver criteria should be made available to stores, especially those in rural areas."
A day earlier, Rehr made another appeal to Baker. Noting that over 20% of seniors are over-air only TV viewers, he asked that special arrangements be made to get coupons to assisted living facilities and nursing homes. "We understand that current NTIA policies and procedures could hinder the efforts of seniors in assisted living facilities and nursing homes to obtain coupons, by utilizing too narrow a definition of "household" for purposes of coupon eligibility. Surely, this is something that can be fixed, perhaps with a designation to identify seniors at an address that has multiple eligible recipients. These citizens deserve to be admitted to the government’s program to ensure continued television reception. While we all value our favorite television programs and rely on television broadcasts for vital weather and emergency information, our senior population above all others cannot be cut off from receiving television programming."
RBR/TVBR observation: The time for common sense and flexibility is now — there is no "next year" any longer. We encourage the FCC, NTIA and Congress to pay close attention when any stakeholder identifies a crack in the DTV transition system and do whatever is needed to plug it immediately.
FCC waves though challenged NCE sale
The 20M sale of WKCP-FM Miami FL (formerly WMCU-FM) from Trinity International Foundation to American Public Media Group back in 2007 sparked a storm of protest from local listeners, and the listeners fired off formal and informal complaints to the FCC in an effort to prevent it. In the end, the effort fell flat.
The deal was filed with the FCC 10/1/07, and a petition to deny from several listeners flowed in almost directly on its heels, on 11/2/07. In support, over 100 other filed informal objections. A laundry list of allegations was swept aside. * The station failed to give adequate notice: It didn’t broadcast announcements, since it obtained authority to go silent for a period, but it did publish the announcement in a local paper. Petitioners challenged how local it was, but Trinity was able to prove that it was published in Miami. * Numerous allegations that Trinity failed to properly disclose ownership were dispensed with for technical or other reasons. * Objections to an expected format change are outside the FCC’s authority. * Contracts were filed without all documents provided: All that are must-haves were in fact provided; others with proprietary or essentially irrelevant information were properly withheld.
There was one area where the FCC seemed to concede there may be wrongdoing. That was the allegation that Trinity continued to solicit listener donations even though it knew it was in negotiation to sell the station to a company that may well scrap the programming the contributors were intending to support. However, FCC claimed that was outside its jurisdiction, and was rather a matter for the judiciary to settle.
RBR/TVBR observation: Interested in when "non-FCC misconduct" becomes a matter in which the FCC will in fact intercede? There are three types: fraudulent statements to a government agency (the FCC often seems to detest lack of candor above all other acts); felony convictions; or anti-competitive/antitrust matters involving mass media companies. If you have a criminal or civil complaint against a broadcaster involving any other type of matter, you might just as well start looking for a judge.
Elections hog the spotlight again
The election fired back over the 50% point during the 3/3/08-3/9/08, according to the lastest survey from the Project for Excellence in Journalism, finally resting at 52%, fueled by another 77% tunnel-vision performance from the cable sector.
Radio was about at par with 54% coverage and network TV was just under at 48% The economy continued its run as the top also-ran, and the total media top ten coverage chart reverted to its 2008 pattern of having ample room for stories on the hit parade with a mere 1-share. Four of them qualified this time around.
And here’s something we can’t ever remember happening since PEJ began producing these charts a little over a year ago: Although there are four foreign categories on the list, and domestic terrorism also qualified, there is not one mention of Iraq to be found.

Gabelli sets debate
This is not a political debate, but rather a face-off between Media General management and dissident shareholder Harbinger Capital Partners over their dueling slates for three Media General board seats. Mario Gabelli will sit in the moderator’s chair and host the session for institutional investors to hear both sides. Gabelli & Company is an even larger Media General shareholder than Habinger and Gabelli has not yet taken sides in the battle.
Marshall Morton, Vice Chairman & Chief Executive Officer of Media General will represent the company at the April 1st session. Joseph Cleverdon, Vice President & Director of Investments, will present on behalf of Harbinger Capital Partners. Harbinger claims Media General needs to refocus its business strategies to better serve its shareholders, while Morton insists that he has the company on the right track for the future.
The three seats at stake account for only one-third of the board of directors. Super-voting shares mostly held by Chairman J. Stewart Bryan and his family elect the other two-thirds.
Taking issue with Jim Boyle
This reader doesn’t think much of the suggestions for the radio industry from CL King analyst Jim Boyle (3/4/08 RBR #44).
WOW–
That is the biggest bunch of bull I’ve heard in a long time — Does Boyle realize how many baseball hats and emails you’d have to sell to make an idiotic idea like that work?
This is the kind of thought process that’s circling Radio — it’s like watching the employees of the Pony Express wonder what they were going to do after they saw the train and telegraph coming. Yes, I was there — it had to feel much like being in radio today—they didn’t stand a chance.
Radio, however, does —
P-1’s and human beings are only interested in CONTENT — also they want to feel connected again to fun irreverent people who share the same lifestyle.
We have programmers trying to program formats they know nothing about, let alone knowing anything about the listeners’ lifestyles — sure they’re fully equipped with stereotypes and hearsay — but most are so busy trying to program so many stations they themselves have no visible lifestyle.
Please stop the Chinese fire drill and develop local content.

Mega-concert this Saturday
What do you get when you assemble 1,000 musicians in a single room for a performance? We’ll find out this Saturday (3/15) as the massive orchestra is assembled cavernous Colisée Pepsi sports arena in Quebec City to perform Gustav Mahler’s Symphony No. 8. The two-hour concert to launch the French Canadian capital’s year-long 400th anniversary celebration will be broadcast and streamed live by the WFMT Radio Network, including live presentations on flagship WFMT-FM Chicago and wfmt.com. Steve Robinson, WFMT’s general manager and executive producer for the Mahler broadcast, says the concert is being offered free, for live or later broadcast, to any radio station that’s interested.
Debut makes its debut
Yesterday marked the first quarterly Wall Street conference call for Debut Broadcasting, which just this week announced the purchase of its sixth and seventh radio stations – all in small, unrated markets. CEO Steven Ludwig told investors that despite what they may have heard about the travails of large market operators, the medium and small markets “have been in a different business for some time now.” As the company grows its small market platform, Ludwig said two other stations are currently under letters of intent and he expects to grow the group to 15-20 by the end of this year.
Debut is also in the syndication business as Impact Radio Networks and growth is foreseen there as well. According to its SEC filing, Debut had just under three million in revenues in 2007, a 7.9% increase over the previous year. About two-thirds of that revenue came from Dial Global, which handles national representation of Debut’s syndicated programming. Ludwig said he expects that ratio to change, not because Dial Global will be selling any less – in fact, he expects them to sell more national advertising – but because he expects Debut to sell more advertising in-house, particularly for sponsorships as opposed to spots.
Debut Broadcasting became a public company last June via a merger with an existing public shell.
Idol crushes the competition (again)
Fox rolled to an easy victory in the weekly Nielsen ratings as "American Idol" again claimed the #1, #2 and #3 spots with viewers.
For week 24 Fox had an average HH rating of 7.1 and an 11 share. CBS was next at 5.3/9, NBC 5.0/8, ABC 4.8/8, Univision 1.9/3, CW 1.5/2, MyNetworkTV 0.9/1, Telemundo 0.6/1, Ion and TeleFutura tied at 0.4/1 and Azteca America at 0.1/0.
The 18-49 results were much the same, with Fox well out in front, followed by NBC, ABC, CBS, Univision, CW, MyNetworkTV, Telemundo, TeleFutura and a tie by Azteca America and Ion.

Goin' to the show
The NAB Show in Las Vegas is on the calendars of FCC Commissioners Jonathan Adelstein (D) and Deborah Tate Taylor (R). They’ll be the featured guests at the Regulatory Face-off pegged for Tax Day, 4/15/08. But you don’t need to wait until then to see them outside the walls of The Portals in SW Washington. This Friday, 3/14/08, they will be joined by colleagues Michael Copps (D) and Robert McDowell (R) at the American Women in Radio & Television 2008 Leadership Summit & Business Conference. That event kicks off Thursday 4/13/08 and runs through Saturday. Also on the playbill are Candy Crowley, Bonnie Press, Henry Rivera, Suze Orman and others.
RBR/TVBR observation: Perhaps they will use this forum to make a joint pitch to Congress from afar to just go ahead and process their renominations to the Commission. It looks like they are going to be hung up due to maneuvering tied to the possible changing of the guard at 1600 Pennsylvania Ave. NW. If Tate has any questions, she need only lean over and ask Adelstein, who has been there and done that more than once.

Saturday Night Live veteran Al Franken has had a major hurdle cleared en route to his attempt to challenge Norm Coleman (R-MN) for the Minnesota Senate seat opposite that of Amy Klobuchar (D-MN), who was able to hold the seat of retiring Mark Dayton (D-MN) for her party over Mark Kennedy. Those looking for this contest to turn into an electoral version of late night topical comedy television have been disappointed, as Franken has been on his best behavior thus far.

Results Radio is a partnership featuring as CEO the long-time Sacramento broadcaster Jack Fritz. "We are delighted that long time local broadcaster Jack Fritz and his partners are acquiring KCCL, said the seller’s Gary Lawrence. "Jack is very community focused and an outstanding station operator." The price was not immediately released.
