Unsolicited promotional messages and advertisements via text message, e-mail, phone calls and via the U.S. Postal Service are disliked by many. For used car buyer James Andrews, it was annoying enough for him to sue the source of this disliked dissemination of perturbing publicity.

The company behind the outreach is Sirius XM Radio.

And, the U.S. Court of Appeals for the Ninth Circuit — considered one of the most liberal in the nation — just declared the satellite radio service and owner of Pandora is perfectly allowed to conduct such a campaign, based on how it received Andrews’ personal information.

The implications are huge for not only Sirius XM Holdings, but also the radio industry.
