Owens, Housewife off the hook
The infamous encounter between Philadelphia Eagles wide receiver Terrell Owens and "Desperate Housewives" star Nicolette Sheridan prior to the 11/15/04 airing of ABC's "Monday Night Football" has been cleared of all charges. Numerous individuals had filed complaints with the FCC alleging that the incident was indecent. Explaining the decision, the Commission wrote, "In particular, the [MNF] segment in question, although sexually suggestive, is not graphic or explicit. Owens is fully dressed throughout the segment, and, with the exception of a moment when her bare back is exposed to the audience, Sheridan is at all times fully covered with a towel. No sexual or excretory organs are shown or described, and no sexual activities are explicitly depicted or described. furthermore, the scene where Sheridan drops her towel and jumps into Owens's arm is brief. Although the scene apparently intended to be titillating, it simply is not graphic or explicit enough to be indecent under our standard." Michael Copps appended comments to the decision, which was supported by all five commissioners, saying, "At a time when recent surveys show that a substantial majority of parents are very concerned that children are being exposed to too much inappropriate content, I would hope that television broadcasters would go the extra mile in exercising self-discipline when airing or promoting programming that may not be appropriate for younger viewers. There wasn't much self-discipline in this particular promotion. As stewards of the public airwaves, broadcasters can and should do better." The decision should not come as a surprise, even to some of the loudest anti-indecency voices. As AFA's OneMillionMoms said just after the incident occurred, "Although we believe this incident would not garner FCC indecency action, you can still let your feelings be known to Terrell Owens, the Philadelphia Eagles organization, and ABC." Disney dissidents begin campaign to fire board
As we predicted (3/14/05 RBR #51), former Disney directors Roy Disney and Stan Gold aren't accepting the current board's vote to name Bob Iger as CEO, come September, as the final word on the subject. Instead, the dissidents are embarking on a new campaign to remove Chairman George Mitchell and the entire board of directors so a new board can start over on the CEO selection process. The two dissidents charged that the search process that led to Iger's naming was a "ruse," with no real consideration given to finding the best candidates possible. "Mr. Mitchell's approach to good governance is no better than a carny at the fair, enticing words but in the end the game is rigged," Roy Disney and Stan Gold raged in a statement denouncing the appointment. What remains to be seen is whether they can again inflame the shareholder outrage that led to a more than 45% no-confidence vote for CEO Michael Eisner in 2004. Since then the company's financial performance has improved - - and ABC Television, in particular, has gotten back on track - - so it may be tougher to build a mass movement to oust the board. Liggins repays loans
Radio One CEO Alfred Liggins has now repaid all of the loans that the company had made to him - - and a little ahead of schedule (2/9/05 RBR #28). According to the company, Liggins made a final payment of approximately six million bucks on an original 21.1 million loan on March 8th and repaid a second loan of 549,000, including interest, on that date as well. Loans to executives became an issue for Radio One in 2002 when such loans became a hot topic on Capitol Hill. Although they were legal when made at Radio One, such loans by public companies are no longer permitted.


Bush had tougher time with the media
An analysis of press coverage of the 2004 presidential campaign shows that President George W. Bush was handled more roughly than challenger John Kerry. 36% of the stories on Bush were negative, compared to 12% for Kerry. Reversing that, Bush received postive coverage 20% of the time, compared to 30% for Kerry, according to a Reuters story. The study comes from the roject for Excellence in Journalism, an arm of the Columbia University Graduate School for Journalism. It studied coverage in newspapers of varying size, four evening broadcast news programs, three broadcast network morning news shows, none cable shows and nine websites. The study said that most people felt that both candidates were handled more roughly than in 2000, but that the press was not a big factor in determining how their votes were cast.

Clinton calling for standardized ratings
At the unveiling of the Kaiser Family Foundation report on age 8-18 media habits, Sen. Hillary Rodham Clinton (D-NY) announced that she would be introducing a bill to further study the effects of media on youth, including children at an even younger age. Like the Kaiser study, it will also focus on video games as well as entertainment programming. She has bipartisan support - - her co-sponsors are Joe Lieberman (D-CT), Sam Brownback (R-KS) and Rick Santorum (R-PA). Most knowledgeable observers would say that the foursome covers an even wider expanse of the ideological spectrum than they do on the political spectrum. At Kaiser, Clinton said she was concerned about much of what is put out by today's media outlets, but was not in favor of censorship-type tactics. Rather, she wants better tools for parents to use to exercise control over what their children have access to. She noted that in the current environment, tools like the v-chip are already becoming obsolete, even before many have bothered to use them. And often, tech-challenged parents are losing the programmer/hacker wars to their more technologically-adept children, who delight in defeating or working around parentally-imposed impediments. In addition to improving such tools, she noted three other areas where involved parties could make voluntary gestures to improve the situation. She wants a uniform, content-based ratings system that is easy for parents to understand and use (possibly one that works across different media); she wants media education, particularly via PSAs aired in prime time, and at other times where there is significant audience (as opposed to the usual PSA graveyard in the early AM); and noting the increasing problem with morbid obesity, especially among the young, she said she wants food advertisers to behave responsibly, particularly in regards to targeting children age 12 or younger. Cars.com announces largest TV buy to date
Cars.com announced its largest ever-national ad buy. The campaign runs now through October on leading cable networks, reaching more than 178 million viewers. The campaign, featuring cars.com's "Find the right car for you" message, is backed by increased promotion across cars.com's network of 200 local newspaper and television partners as well as an aggressive online marketing initiative. As part of its 2005 buy, cars.com will have a dominant media presence on leading sports programs, including sponsorship of ESPN's "SportsCenter" In addition to features like 'Top-Ten' and 'Call of the Day,' cars.com will also sponsor the upcoming NFL Draft, 4/23 on ESPN. For the first time, cars.com will also advertise in live sporting events, with spots scheduled to air during Major League Baseball, NBA and PGA Golf. Cable includes Discovery, Food Network, TBS, TLC, TNT, USA and WGN. Spots are scheduled to run on syndicated favorites such as "Seinfeld," "Sex and the City," and "Law & Order: SVU," and on original programming hits like "Trading Spaces," "American Chopper," "Monk," and "Emeril Live." Popular automotive programs "Overhaulin'" and "Rides" are also part of the mix. In addition: automotive tips on TLC programming, as well as features on TBS's "Dinner and a Movie" and USA's "Big Movie Sunday."

CC Outdoor launches multicultural initiative
Clear Channel Outdoor is expanding its focus on serving the fast growing U.S. Hispanic and African American population. The company launched a Multicultural Sales and Marketing Initiative, leveraging the company's presence in the nation's largest Hispanic and African American markets. Leading this effort are outdoor advertising veterans Peter Milian, who is Vice President Hispanic Sales and Marketing, and Tony Dailey, VP/Multicultural Sales and Marketing. CC Outdoor has a presence in and offers advertising products and services in 9 of the top-10 largest Hispanic and African American markets.

At deadline: Kent out at Universal McCann
With General Motors threatening to take it's nearly three billions bucks of business elsewhere (3/14/05 RBR #51), Interpublic is making a key executive change. Robin Kent has been given the heave-ho as CEO of Universal McCann, with COO Murray Dudgeon taking over on an interim basis. Kent is still with parent Interpublic Group and McCann Erickson WorldGroup CEO John Dooner said in a statement that Kent will work with him "on special Interpublic media projects."

Adam strengthens grip on Mega
George Lindemann's share of Hispanic radio specialist Mega Communications is going from 18% to almost zip (0.5%), while son Adam jumps from 82% to 98.5% in a deal valued at 35M dollars. Tender offered will be in the form of a promissory note. The group consists of the following. In Washington: WKDL-AM Alexandria VA, WBPS-FM Warrenton VA & WBZS-FM Prince Frederick MD; in Tampa-St. Petersburg-Clearwater: WLCC-AM Brandon FL & WMGG-AM Largo FL; in Philadelphia: WEMG-AM Camden NJ; and in Orlando: WNUE-FM Titusville FL. Also mentioned in the transaction is Boston: WAMG-AM Dedham MA & WLLH-AM Lowell MA, the 9M dollar sale of which is pending (2/24/05 RBR #39).

Close encounter in Phoenix
Mike Cutchall's Sun City Communications has closed on its 18.7M acquisition of KFMR-FM from Desert West Air Ranchers, according to the brokers at Kalil & Co., who handled the deal. The station puts out 36 kW over 95.1 mHz from Sun City West, a suburban hub just west of the city limits.

Senate seat opening up
Paul Sarbanes (D-MD) has become the second Democrat and third senator overall to announce plans to retire rather than seek re-election in 2006. The other Dem is Mark Dayton (D-MN). On the other side of the aisle, majority leader Bill Frist (R-TN) has said he won't stand for re-election. Democrats stand a much better chance of holding Sarbanes' seat than they do that of Dayton, who is retiring rather than face what seems to be an uphill battle to stay in the Senate. In Frist's case, he may be mulling throwing his hat into the ring to head the Republican ticket in 2008 as the party's presidential candidate.

family-friendly Fish

There are no worries about running into anything that might draw an indecency fine from the FCC on Salem's stations that carry the "Fish" Contemporary Christian format, so the company is using that as a selling point. In the LA market, KFSH-FM invited families to enter the "Ultimate Fish Families" contest with an essay and photo. The four winning families are now the "face" of the family-friendly radio station on billboards throughout Orange County.

Stock Talk
Disney helps boost the market
Wall Street gave a thumbs up to Bob Iger's selection as CEO-designate of Disney, pushing the company's stock up 1.6%. Disney is a component of the Dow Jones Industrial Average, which gained 30 points, or 0.3% for the day, to 10,804.

Radio stocks were mostly higher. The Radio Index rose 0.767, or 0.4%, to 220.902. Arbitron led the way, up 3%. Regent gained 2.4% and Emmis 2%.

The debate continues over :30s vs. :60s.

I just had to respond to the account manager from Clear Channel regarding thirty second spots (3/9/05 TVBR #48). There is no doubt many 60's just rail on and on with nothing but a laundry list menu of everything the store owner has to offer. However, really well done theater of the mind commercials take a 60 to do well. Maybe if local radio reps and their managers learned to sell ideas and concepts to their clients, instead of "We're Number One" and price and "packages," they may have better sounding spots and get better results for their clients. Effective radio advertising is the right blend of reach, frequency and MESSAGE. You can run an irritating spot 100 times in a week, but if the listener pushes the button, they won't hear it and it won't produce results. By the way, I never heard a Clear Channel rep mention the idea of using thirties until the Company proclaimed it an edict. Now, suddenly, "thirties are the way to go"!

Zellner to join XM
XM Satellite Radio announced that Jon Zellner, former Vice President of Adult Top 40/Hot AC Programming at Infinity Broadcasting, will be joining XM to serve in the newly-created position of Senior Vice President of Music Programming. At Infinity, Zellner oversaw Adult Top 40/Hot AC stations in 17 cities.

IBiquity taps three
iBiquity Digital has expanded its broadcast marketing department, hiring Renee Jamerson and Roy Sampson, who join the company as Managers of Broadcast Marketing where they will work with radio stations on promoting HD Radio. iBiquity also hired Vicki Stearn as Director of Marketing and Communications. She had been a communications consultant to HD Radio during the fourth quarter of 2004.

Steele back in Houston
Dayna Steele, who's been called "Houston's First Lady of Radio," returned to the airwaves yesterday as host of a one-hour afternoon show on how "you can master the art of doing business" on KXYZ-AM "BizRadio1320."

GM puts 3 billion account
up for grabs
Mark LaNeve is wasting no time shaking things up after being but in charge of all domestic sales and marketing at General Motors early this month. He's put the company's entire US media buying account up for review. The GM account, which totaled nearly three billion bucks in ad buying last year, is apparently the largest ad contract ever put up for bid. It covers buying for both General Motors and its regional dealer groups. LaNeve is looking for new ways to boost sales for GM, whose US market share has fallen to a historic low. RBR observation: Ok you were not there at the 4A's this year when the buzz was creative and the problems agencies are having wrestling the issue under control. Reminder: LaNeve stated he wants to keep auto offers simple in the market place and be more targeted on incentives by models and regions of the country. In short: Price the car right and no incentives. LaNeve was the point on re-branding the Cadillac division so successfully he is now the man in charge of 3 billion bucks and the up front season is around the corner. So, now do you think LaNeve is going to commit all that cash at one time? 03/14/05 RBR #51

Powell heading to Think Tank
When he leaves the FCC this week, Michael Powell's first stop with be the Aspen Institute, a think tank that's also been a post-FCC home for ex-Chairmen Reed Hundt and Bill Kennard. Powell will become senior fellow of the Aspen Institute Communications and Society Program for a three-month period effective upon his departure from the FCC. He will advise the Communications and Society Program on leadership, communications policy, and program activities and operations. Judith Mann will also move from the FCC to the Institute as Powell's confidential assistant. RBR observation: Seems many go to some form of Think Tank after their experience at the FCC. Mostly to think why they went there in the first place, second is what did they screw up for the communications business while they were there - - a business called radio and TV which they never were employed in, but became overnight experts in judging what is best for all. It's like going to a clinic to dry out. 03/14/05 RBR #51

Bob Iger to CEO when
Michael Eisner retires
Speeding up his retirement timetable and will step down on September 30th of this year. EBay CEO Meg Whitman withdrew from consideration for the Disney post late Friday - - and that Iger was the only other candidate remaining. Whitman's withdrawal, which was confirmed, came just hours after former Disney directors Roy Disney and Stan Gold sent a letter to the current board demanding that Eisner be kept out of the interview process to select his successor because he had already publicly endorsed Iger.
RBR observation: If you've been reading "DisneyWar" by James Stewart, get ready for the sequel - - Disney War II - - as Roy Disney and Stan Gold go ballistic over the current board anointing Iger after such a brief and half-hearted search for outside candidates. Since it's nearly a year until the next scheduled shareholders meeting, we'd guess that the two will strike while the iron is hot and start soliciting support to call a special meeting and try to fire the entire Disney board.
